Supreme Court Takes Up Case on Presidential Tariff Powers

Preview

Today, the United States Supreme Court begins hearing arguments in a major case about presidential powers and trade policy.

The case focuses on how the President can use emergency powers under the International Emergency Economic Powers Act (IEEPA), a law originally designed for sanctions, to impose tariffs on imports.

A ruling against the President’s use of IEEPA would not eliminate tariffs altogether, as there are other legal authorities that allow the administration to impose trade measures. However, it could restrict this specific pathway for creating tariffs. While a decision is not expected for several months, the outcome may shape how future U.S. trade measures are designed.
